When Amazon France deactivated tens of thousands of non-EU seller listings in 2022 and 2023, two questions came back from the affected sellers within hours. What is this mandataire REP the platform is asking for, and where do I find one. This article answers the first question completely. The second question we cover in our pricing page.
The role is not a French novelty. It is the local implementation of Article 8a(5) of EU Directive 2008/98/EC, which lets Member States open EPR registration to producers established in other Member States via a local representative. France went further by extending the mechanism to producers established outside the EU entirely. The combination of EU directive, French AGEC law, and the post-EcoDDS civil mandate doctrine is what makes the modern mandataire REP role.
Definition in one sentence
A mandataire REP français is a France-established legal entity that a foreign producer designates by written mandate to perform French EPR registration, declaration and administrative tasks in the producer’s name and on the producer’s behalf, without taking on the producer’s legal responsibility.
That definition contains five operational elements worth unpacking.
Five things a mandataire actually does
One — designation by written mandate. The producer signs a contract — usually electronic, no notary required — appointing the representative for one or more EPR streams. The mandate is a civil mandate under Articles 1984 and 1998 of the Code civil. It can cover one stream (packaging only) or all streams the producer is in scope of.
Two — eco-organism registration in the producer’s name. The representative opens dossiers with the relevant eco-organisms (Citeo for packaging, Refashion for textile, Ecosystem for WEEE, Corepile for batteries, Ecomaison for furniture, and so on). Each dossier names the producer as the legally registered entity, with the representative as the operational point of contact.
Three — IDU issuance and SYDEREP publication. Once the eco-organism approves the dossier, ADEME issues a unique producer ID (IDU) per stream and publishes it on the SYDEREP teleservice. Marketplaces query this registry. The representative monitors publication and confirms each IDU to the producer.
Four — annual declarations and payment. Each year, by 28 February for the previous year’s tonnage, the representative files declarations with each eco-organism on the producer’s behalf. The eco-organism computes the eco-contribution. The representative either pays directly and re-invoices the producer, or facilitates direct payment by the producer — depending on contractual setup.
Five — interface with French administration. If ADEME, DGCCRF or French customs sends correspondence, the representative receives it as the French point of contact, advises the producer and coordinates the response. Five things a mandataire does not do
Equally important — the things the representative is not legally allowed or expected to do, where misunderstanding causes the most trouble.
It does not take on producer liability. Penalties under L. 541-9-6 hit the producer, not the representative. The producer remains the legally obligated party. This was made explicit by the Conseil d’État in its EcoDDS ruling of 10 November 2023, which we cover in detail in the EcoDDS ruling article.
It does not import goods. The mandataire is not an importer of record, does not handle customs clearance, and does not take title to your products. Those activities are commercially distinct.
It does not warehouse or fulfil. EPR representation is administrative. It does not run a French warehouse for your benefit.
It does not file your French VAT. EPR and VAT are separate regimes with separate registrations. Your French VAT, if you owe it, is filed through your accountant or your IOSS/OSS facility.
It does not redesign your products. Upstream obligations under PPWR (recycled content targets, design-for-recycling, labelling) remain on the producer. Why the role exists at all
Two answers, one legal and one practical.
The legal answer is that France allows non-EU producers to register for EPR, but does not allow a non-French legal entity to be the registered party on the SYDEREP register. A US LLC cannot open a Citeo dossier directly; a French entity must do it on its behalf. The mandataire is that French entity.
The practical answer is operational. Eco-organisms exchange correspondence in French, on French timelines, with French banking arrangements. Without a French entity in the loop, dossiers stall, declarations miss deadlines, IDUs do not get published, and marketplaces deactivate listings. The mandataire is the operational machinery that keeps the dossier alive.
What to look for when choosing one
Three things matter much more than they appear at first.
Published pricing. A representative that hides its fee behind a quote form will end up costing more, with surprises like per-SKU surcharges or volume tiers triggered after onboarding. Our flat pricing is published at /pricing. If your prospective representative cannot publish theirs, ask why.
Post-EcoDDS contract. The mandate must explicitly reference the civil mandate framework under Articles 1984 and 1998 of the Code civil. Mandates drafted before November 2023 sometimes use a subrogation framing that the Conseil d’État rejected. Ask to see the mandate template before signing.
Stream coverage. If your catalog spans packaging, WEEE and batteries, you want one representative for all three, not three separate engagements. Coverage breadth signals operational maturity.
What it costs to do nothing
The cost of not engaging a representative when you should:
- Amazon France, Cdiscount, ManoMano, Fnac Marketplace deactivate listings progressively.
- ADEME or DGCCRF can issue a mise en demeure followed by fines up to €30,000 per SKU per violation under L. 541-9-6.
- French customs can seize inbound shipments at the border if the producer is on the ADEME non-compliance list.
- Reputational damage with B2B partners who run their own supplier compliance checks.
For an FBA seller with 20 SKUs across packaging + WEEE + batteries, theoretical exposure is around €600,000. The annual cost of compliance via a representative is €3,500 to €6,000 all-in for the same profile.
FAQ
Can I use a French law firm as my mandataire REP?
A law firm can advise on the mandate and on French EPR law, but operating as a mandataire REP is not a legal-services activity. The mandataire must be a France-established commercial entity that can sign mandates with eco-organisms, submit declarations to SYDEREP, hold the producer ID on its statutory record, and bear the operational obligations of representation. Most law firms do not perform this role; specialist EPR representatives do.
Does the mandataire take legal responsibility for my EPR compliance?
