How to Switch Your French EPR Representative Without Losing Your IDU

You can switch your French EPR authorized representative at any time. The procedure to do it cleanly, without losing your IDU or triggering marketplace deactivation.

Switching French EPR representatives is more common than producers expect. Reasons range from price (moving from a hidden-cost provider to a transparent flat-fee one — see /blog/budgeting-french-epr-hidden-costs-vs-flat-fee) to operational quality (slow declaration filing, missed deadlines, unresponsive support) to acquisition (your previous representative merged with a less suitable parent).

The good news: switching is straightforward and the IDU is portable. This article walks through the procedure to switch cleanly without losing your IDU or triggering marketplace deactivation.

The legal context

The mandate between a producer and an authorized representative is a civil mandate under Articles 1984 and 1998 of the Code civil, confirmed by the Conseil d’État in its EcoDDS ruling of November 2023 (see /blog/ecodds-conseil-detat-ruling-civil-mandate). Like any civil mandate, it is revocable by the producer at any time, subject to the contractual notice period agreed at signing.

Three things this means in practice:

  1. You can switch representatives at any time, subject to contract notice.
  2. The IDU belongs to you (the producer), not to the representative.
  3. The outgoing representative must transition the file to the new representative on reasonable terms.

The switching procedure

Step-by-step:

Step 1 — Read your current contract. Note the notice period (typically 30-90 days) and any termination conditions. Some providers tie termination to the end of an annual cycle — these clauses are negotiable but legally binding if accepted.

Step 2 — Engage the new representative. Mandate signed electronically (same day in most cases). The new representative prepares the transition paperwork.

Step 3 — Notify the outgoing representative. Written notice (email + registered letter if the contract requires it) within the notice period. Specify the effective date of termination.

Step 4 — Inform each eco-organism. The new representative files updated mandate information with each eco-organism your file is registered with. The eco-organism processes the change within 5-15 business days.

Step 5 — Confirm IDU continuity on SYDEREP. The IDU remains the same; only the representative-of-record changes in the eco-organism’s internal records. Verify on SYDEREP that the producer name and IDU are unchanged.

Step 6 — File handover. The outgoing representative transmits historical records (eco-organism dossier copies, declaration history, eco-contribution invoices) to the new representative.

What to do if your current representative is uncooperative

If the outgoing representative delays the handover beyond reasonable expectations:

  • Send a written demand with a deadline (typically 15 business days).
  • If still no response, your new representative can re-construct the file by filing fresh data with each eco-organism. The IDU stays the same; the eco-organism updates its internal records based on the new mandate.
  • In extreme cases, escalate via the producer’s right to access its own data under the GDPR.

In practice, even uncooperative providers usually comply once the producer formally engages a new representative and the eco-organism receives the updated mandate.

What does not change during a switch

  • Your IDU on SYDEREP.
  • Your producer name on the eco-organism record.
  • Your stream coverage (filings stay live).
  • Marketplace verifications (which query SYDEREP).
  • Your eco-contribution obligations (volumes declared continue under the same producer).

Marketplaces do not need to be notified of the change. They continue to verify against the same IDU.

Why and when to switch

Common reasons:

  • Pricing: moving from opaque-pricing provider to transparent flat-fee.
  • Operational quality: slow IDU publication, missed declarations, unresponsive support.
  • Scope expansion: previous representative covered packaging only, new scope needs WEEE + batteries.
  • Post-EcoDDS mandate update: contracts predating November 2023 with subrogation language should be replaced.
  • Acquisition / merger: your representative was acquired by a less suitable provider.

FAQ

Do I lose my IDU when I switch representatives?

No. The IDU is issued to your producer entity, not to the representative. The representative is the operational point of contact and the mandate signatory with the eco-organism. Switching the representative does not change the producer record on SYDEREP — the IDU remains the same and stays live throughout the transition.

How long does a representative switch take?

Typical timeline is 2-4 weeks. The new representative signs a mandate with you, then files updated representative information with each eco-organism. The eco-organism processes the change within 5-15 business days. Throughout the transition, the IDU stays live and marketplaces continue to verify successfully.

Can my current representative refuse to release my file?

No. The mandate is a civil contract under Articles 1984 and 1998 of the Code civil. You retain the right to revoke the mandate. The outgoing representative is obligated to deliver your file (eco-organism records, declaration history, supporting documents) to your new representative within a reasonable period. If they delay, your new representative can re-file the dossier with the eco-organism using new producer-provided data.
